1. Introduction

This Privacy Policy describes how Chauffit LLP collects, uses, stores, processes, discloses, transfers, and protects personal data of users, drivers/service providers, bikers/service partners, visitors, and any other individuals interacting with the Chauffit mobile application, website, platform, or services ("Platform").

Chauffit operates a technology-based platform facilitating "driver-on-call" services wherein users may book independent drivers through the Platform. Chauffit further facilitates mobility assistance for drivers through independent biker service providers to enable transportation of drivers from one location to another for operational convenience.

This Privacy Policy is framed in compliance with applicable Indian laws including:

  • The Digital Personal Data Protection Act, 2023 ("DPDP Act");
  • The Information Technology Act, 2000 ("IT Act");
  • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
  • Applicable intermediary and data protection regulations.

By accessing or using the Platform, you consent to the collection and processing of your personal data in accordance with this Privacy Policy.

2. Definitions

For the purposes of this Privacy Policy:

  1. User means any individual who books or avails services through the Platform.
  2. Driver means an independent service provider onboarded by Chauffit for providing driving/chauffeur services.
  3. Biker means an independent service provider engaged for facilitating transportation/logistics support of Drivers.
  4. Personal Data means any data about an identifiable individual.
  5. Processing shall include collection, recording, storage, organization, use, sharing, disclosure, transfer, or deletion of personal data.
  6. Platform includes mobile applications, websites, software, APIs, communication systems, and related technological infrastructure operated by Chauffit.

3. Nature of Services

Chauffit is solely a technology platform facilitating interaction between Users and independent service providers including Drivers and Bikers.

Drivers and Bikers are independent service providers and shall not be construed as employees, agents, partners, representatives, or workers of Chauffit.

Chauffit does not own transportation vehicles nor directly provide driving or transportation services.

4. Information We Collect

A. Information Collected from Users

We may collect the following information from Users:

  • Full name;
  • Mobile number;
  • Email address;
  • Residential or pickup/drop location;
  • GPS/location information;
  • Vehicle details;
  • Payment details;
  • Booking history;
  • Device information;
  • IP address;
  • App usage information;
  • Communication records;
  • Emergency contact information (if voluntarily provided).

B. Information Collected from Drivers

We may collect:

  • Name and contact details;
  • Photograph;
  • Government-issued identification documents;
  • Driving license details;
  • Address proof;
  • Police verification records;
  • Banking/payment details;
  • Vehicle information (if applicable);
  • Background verification documents;
  • Live location/GPS data during active services;
  • Ratings and feedback.

C. Information Collected from Bikers

We may collect:

  • Name and contact details;
  • Identification documents;
  • Vehicle details;
  • Driving license;
  • GPS/location data;
  • Banking/payment information;
  • Trip and service history.

D. Automatically Collected Information

We may automatically collect:

  • Device ID;
  • Browser type;
  • Operating system;
  • App crash reports;
  • Cookies and analytics data;
  • Log files;
  • Session information;
  • Internet protocol (IP) address.

5. Purpose of Collection and Processing

We process personal data for lawful purposes including:

  • Facilitating bookings and service requests;
  • Matching Users with Drivers and Bikers;
  • Enabling operational coordination;
  • Identity verification and onboarding;
  • Payment processing and settlements;
  • Customer support;
  • Fraud detection and prevention;
  • Safety and security monitoring;
  • Regulatory compliance;
  • Legal dispute resolution;
  • Internal analytics and improvement of services;
  • Communication regarding bookings, updates, offers, or alerts;
  • Compliance with court orders or governmental directions.

6. Consent

By using the Platform, registering an account, or availing services, you provide free, specific, informed, unconditional, and unambiguous consent for processing of your personal data for the purposes stated herein.

Users, Drivers, and Bikers may withdraw consent by contacting Chauffit; however, such withdrawal may affect access to Platform services.

7. Sharing of Personal Data

We may share personal data only on a need-to-know basis and for lawful purposes.

A. Sharing Between Participants

User to Driver

Limited information including:

  • Name;
  • Contact number;
  • Pickup/drop location;
  • Booking details.

Driver to Biker

Only operationally necessary information may be shared, including:

  • Driver name;
  • Contact number;
  • Pickup/drop points;
  • Limited trip coordination details.

Restriction on Bikers

Bikers shall not have access to:

  • User personal profile information;
  • Payment details;
  • Sensitive booking history;
  • Confidential user data beyond operational necessity.

B. Third-Party Service Providers

We may share data with:

  • Payment gateways;
  • Verification agencies;
  • Cloud storage providers;
  • Analytics providers;
  • Customer support vendors;
  • Government authorities where legally required.

C. Legal Disclosures

We may disclose information:

  • To comply with legal obligations;
  • Pursuant to court orders or government requests;
  • For prevention of fraud or cyber incidents;
  • To enforce contractual rights;
  • To protect safety, rights, or property.

8. Data Retention

Personal data shall be retained only for as long as necessary for:

  • Fulfilment of service purposes;
  • Legal or regulatory compliance;
  • Dispute resolution;

Upon expiry of retention requirements, data may be deleted, anonymized, or securely archived.

Chauffit implements reasonable security practices and procedures as required under the IT Act and applicable rules, including:

  • Encryption measures;
  • Secure servers;
  • Access control mechanisms;
  • Firewalls and monitoring systems;
  • Authentication procedures;
  • Periodic security review.

However, no electronic transmission or storage system is completely secure and Chauffit does not guarantee absolute security.

10. User Rights Under DPDP Act

Subject to applicable law, individuals may exercise the following rights:

  • Right to access personal data;
  • Right to correction and updating;
  • Right to erasure;
  • Right to grievance redressal;
  • Right to withdraw consent;
  • Right to nominate another person in accordance with law.

11. Cookies and Tracking Technologies

The Platform may use cookies and similar technologies for:

  • User authentication;
  • Session management;
  • Performance analytics;
  • Improving user experience.

Users may disable cookies through browser settings, though some Platform features may become unavailable.

12. Location Data

Real-time and background location access may be required for:

  • Matching Drivers and Users;
  • Navigation and trip coordination;
  • Driver and Biker logistics support;
  • Safety monitoring;
  • Fraud prevention.

Location access permissions may be managed through device settings; however, disabling location services may affect Platform functionality.

13. Children's Privacy

The Platform is not intended for individuals below 18 years of age.

Chauffit does not knowingly collect personal data of minors without lawful authorization.

14. Cross-Border Data Transfer

Personal data may be processed or stored on servers located outside India subject to applicable legal safeguards and governmental permissions, if any.

By using the Platform, you consent to such transfer where necessary for service operations.

15. Third-Party Links

The Platform may contain links to third-party websites or services. Chauffit shall not be responsible for the privacy practices, content, or policies of such third parties.

Users are advised to review their respective privacy policies independently.

17. Limitation of Liability

Chauffit acts merely as an intermediary technology platform and shall not be responsible for:

  • Acts or omissions of Users, Drivers, or Bikers;
  • Unauthorized disclosures caused by third parties;
  • Service interruptions beyond reasonable control;
  • Indirect, incidental, or consequential damages arising from use of the Platform.

18. Modifications to This Privacy Policy

Chauffit reserves the right to amend or update this Privacy Policy at any time.

Updated versions shall be published on the Platform with revised effective dates. Continued use of the Platform after updates constitutes acceptance of the revised Privacy Policy.
